Is The Baby Here – Privacy Policy

Is The Baby Here (“Is The Baby Here,” “we,” “us,” or “our”) operates https://isthebabyhere.net/ (the “Service”). The Service lets expecting and new parents and guardians (“Account Holders”) create a page with a due-date countdown, updates, photos, birth announcements, registry links, and messages from friends and family. People who visit a family page or sign up for an arrival alert are referred to in this policy as “Visitors” or “Subscribers.”

This Privacy Policy explains what information we collect, how we use and disclose it, and the choices available to you. By using the Service, you acknowledge the practices described in this policy. If you do not agree, please do not use the Service.

1. Information We Collect

Information from Account Holders

We may collect:

  • Account and profile information, such as your name, email address, username, password, and information received when you choose to sign in with Google.
  • Pregnancy and birth information, such as a due date, arrival date, baby’s first name or nickname, birth details, milestones, and other information you choose to include in updates.
  • Content, such as text updates, photos, birth announcements, registry links, and page settings.
  • Communications, including support requests and other messages you send to us.

Passwords created directly through the Service are handled by WordPress and are stored in hashed form rather than as readable text. If you use Google sign-in, Google authenticates you and provides us with account information such as your name and email address; we do not receive your Google password.

Information from Visitors and Subscribers

We may collect:

  • Arrival-alert information, such as the email address you enter when asking to be notified of a baby’s arrival.
  • Family notes, including the name and message you choose to post on a family page.
  • Communications, including support requests and other messages you send to us.
  • Email delivery information, such as whether an alert was sent, delivered, or failed, to the extent provided by our email service providers.

Information Collected Automatically

When you use the Service, we and our service providers may automatically collect:

  • IP address;
  • browser type and user-agent information;
  • device type and operating system;
  • requested pages, dates and times of access, and referring pages;
  • cookie and login-session information; and
  • security, error, and spam-prevention information.

We use this information to deliver pages, keep users signed in, secure the Service, prevent abuse, and troubleshoot problems.

We also use Google Analytics to understand how Visitors find and use the Service. Google Analytics may collect information such as pages viewed, interactions with the Service, approximate location, browser and device information, session statistics, referring pages, and a pseudonymous client identifier stored in a cookie. Google receives the page URL and IP address as part of the connection. In Google Analytics 4, IP addresses are used during collection, including to derive approximate location, and are not logged or stored by Google Analytics.

Photos and Metadata

Uploaded photos may contain metadata, potentially including when, where, or with what device a photo was created. Account Holders should remove location information they do not want to disclose before uploading an image. We do not guarantee that all metadata will be removed during upload.

2. Sensitive Pregnancy, Birth, and Child-Related Information

Due dates, pregnancy status, birth information, and related updates may be considered sensitive or consumer health information in some jurisdictions. We process this information to create and operate the family page and provide the features requested by the Account Holder. We do not use this information for targeted advertising, data brokerage, or the independent marketing purposes of third parties.

Account Holders decide what child-related content to submit and are responsible for having the authority to upload and share it. Please avoid posting medical records, government identification numbers, precise home addresses, or other information that is unnecessary for the Service.

3. How We Use Information

We use personal information to:

  • create and administer accounts and family pages;
  • display due-date countdowns, updates, photos, announcements, registry links, and family notes;
  • authenticate users, including through Google sign-in when selected;
  • send account, security, confirmation, welcome, and password-reset emails;
  • send an arrival alert to a Subscriber who requested it when the Account Holder announces the baby’s arrival;
  • respond to support requests;
  • detect spam, fraud, abuse, and security incidents;
  • maintain, troubleshoot, and improve the Service;
  • comply with applicable law and enforce our terms; and
  • protect the rights, safety, and security of users, the Service, and others.

We do not use family photos, pregnancy or birth information, family notes, or Subscriber email addresses for targeted advertising.

4. Who Can See Family-Page Information

Account Holders share their family-page link with the people they choose. Unless a page is protected by an access-control feature that expressly says otherwise, a person who obtains the page link may be able to view the information displayed on that page. Recipients can also save, copy, screenshot, forward, or otherwise disclose content outside the Service, which we cannot control.

Photos stored in WordPress may have their own media URLs. Account Holders should not upload content that they would be uncomfortable having viewed by someone who receives or discovers the relevant page or media link.

Family notes are displayed on the family page on which they are submitted. The Account Holder and website administrator may moderate or remove them. A note that has already been viewed, copied, or included in a notification cannot be recalled from a recipient’s possession.

5. How We Disclose Information

We may disclose information in the following circumstances:

  • At an Account Holder’s direction. We display family-page content and send requested arrival announcements as part of providing the Service.
  • Service providers. Vendors process information for functions such as website hosting, data storage, authentication, analytics, email delivery, security, and spam prevention. Current integrations may include WordPress and the website’s hosting provider; Google for optional sign-in, reCAPTCHA, and Google Analytics; and MailerLite and MailerSend for email management and delivery. These providers process information under their own terms and privacy commitments.
  • Linked services. If you follow a registry or other third-party link, the destination service may receive information such as your IP address and the referring page and will process information under its own privacy policy.
  • Legal and safety reasons. We may disclose information when reasonably necessary to comply with law or legal process; investigate fraud or abuse; enforce our terms; or protect the rights, property, or safety of the Service, its users, or others.
  • A transfer of the Service. If ownership or operation of the Service changes, information may be transferred as part of that transaction, subject to applicable law and the commitments in effect at that time.
  • With your consent. We may disclose information in another way when you direct us or give us permission.

We do not sell personal information for money or disclose personal information for cross-context behavioral advertising. If our practices change, we will update this policy and provide any choices required by law before applying the change.

6. Cookies and Similar Technologies

The Service uses cookies that are necessary to operate WordPress and provide account features. Depending on how you use the Service, these may include:

  • a temporary cookie that checks whether your browser accepts cookies and is generally discarded when you close your browser;
  • login and authentication cookies that keep you signed in;
  • a “Remember Me” cookie that may keep you signed in for up to two weeks;
  • cookies that remember display or account preferences; and
  • a short-lived cookie used during the Account Holder onboarding process.

You can delete or block cookies using your browser settings, but doing so may prevent login or other Service features from working correctly.

The Service may use Google reCAPTCHA on forms to detect automated abuse. When reCAPTCHA is active, Google may receive technical and interaction information subject to Google’s applicable terms and privacy policy.

We use Google Analytics cookies, including the _ga cookie, to distinguish pseudonymous Visitors and sessions and to measure use of the Service. Information collected through Google Analytics may include page views, interactions, approximate location, device and browser information, and referral information. Google processes this information as described in its Privacy Policy and its explanation of how Google uses information from sites that use its services.

You can limit analytics cookies through your browser settings. Google also offers a Google Analytics opt-out browser add-on. Where applicable law requires consent before analytics is activated, we will provide an appropriate consent choice. If we introduce advertising cookies or connect Analytics data to advertising services, we will update this policy and provide any additional choices required by law.

7. Email Alerts and Choices

A Visitor may voluntarily enter an email address on a family page to request an alert when the baby arrives. We use that address to confirm the request and deliver the requested alert. We do not currently send SMS arrival alerts.

You may opt out using any unsubscribe mechanism included in an email or by contacting us at info@isthebabyhere.net. We may still send non-promotional messages necessary to administer an account, complete a request, or address security or legal matters.

8. Data Retention

We retain account information and family-page content while the account or page remains active. We retain other information only for as long as reasonably necessary for the purpose for which it was collected, including:

  • arrival-alert addresses until the requested alert is sent, the Subscriber opts out, the associated page is deleted, or the information is no longer operationally necessary;
  • family notes while the associated family page remains active, unless removed earlier;
  • support communications for as long as needed to resolve the request and maintain appropriate records; and
  • technical and security records for periods reasonably necessary to protect the Service, investigate incidents, and comply with law.

When information is deleted from active systems, copies may remain temporarily in backups until those backups are overwritten in the ordinary course. We may retain limited information when required by law or reasonably necessary to prevent fraud, resolve disputes, enforce agreements, or document a privacy request.

9. Your Choices and Rights

Depending on where you live, you may have the right to:

  • request access to or a copy of personal information associated with you;
  • correct inaccurate personal information;
  • request deletion of personal information;
  • withdraw consent for future processing where processing is based on consent;
  • opt out of arrival-alert emails; and
  • appeal a refusal to act on a request, where applicable.

Account Holders may be able to edit certain information using the Service’s account controls. To submit a privacy request, email info@isthebabyhere.net. Please describe your request and identify the relevant account, family page, alert subscription, or family note. We may need to verify your identity and authority before completing a request. We will respond within the period required by applicable law.

These rights may be subject to exceptions. For example, we may be unable to delete information we are legally required to retain or information needed for security, fraud prevention, or the establishment or defense of legal claims. We will not discriminate against you for exercising an applicable privacy right.

10. Children’s Privacy

The Service is intended for adults and is not directed to children under 13. We do not knowingly permit children under 13 to create accounts or directly submit personal information. Adults may choose to upload photos and information relating to their children as part of creating a family page.

If you believe a child under 13 has submitted personal information directly to the Service, contact us at info@isthebabyhere.net so that we can investigate and take appropriate action.

11. Security

We use administrative and technical measures designed to protect personal information, including WordPress authentication controls, access restrictions, encrypted HTTPS connections, and security checks on forms. Nevertheless, no online service or storage system is completely secure, and we cannot guarantee absolute security.

Account Holders are responsible for using a strong, unique password; protecting login and magic-link emails; limiting distribution of family-page links; and promptly notifying us of suspected unauthorized access.

12. International Users

The Service is operated from the United States. If you access it from another country, your information may be transferred to and processed in the United States and other countries where our service providers operate. Those countries may have data-protection laws different from those where you live.

13. Third-Party Websites and Embedded Content

The Service may contain links to third-party registries or other websites. Following a link takes you to a service we do not control. If we embed third-party content directly on a page, the provider of that content may collect information about your device and interaction much as it would if you visited its website directly. This policy does not govern third-party services, and we encourage you to review their privacy policies.

14. Changes to This Policy

We may update this Privacy Policy to reflect changes to the Service, our practices, or applicable law. We will post the revised policy with a new effective date. If a change is material, we will provide additional notice when appropriate. We will seek consent before using previously collected information for a materially different purpose when required by law.
